1. Scope of Application

These General Terms and Conditions apply to all business relationships between Tom Tasty AG, Seestrasse 513, 8038 Zurich (hereinafter "Tom Tasty") and its customers in the version valid at the time of the conclusion of the contract.

2. Conclusion of Contract

The contract is concluded by Tom Tasty's acceptance of the customer's order. Acceptance is made by a written confirmation message or by execution of the order.

3. Products and Services

3.1 Product Description

Tom Tasty prepares ready-made meals consisting of fresh, natural ingredients without additives. The recipes focus on local and seasonal products. In addition, Tom Tasty may sell other products in the food sector.

3.2 Visual Materials

Images of products on the website or in apps are illustrations and do not contractually bind Tom Tasty.

3.3 Payment Terms

Payments can be made via credit card.

5. Delivery and Shipping

5.1 Shipping Conditions

The products are shipped in insulated boxes that guarantee a 24-hour cold chain. Shipping is exclusively within Switzerland and Liechtenstein.

5.2 Liability in the Absence of the Customer

In the absence of the customer at the time of delivery, the package will be left near the front door or mailbox. Tom Tasty assumes no liability for theft or damage in this case.

6. Storage and Perishability

The delivery must be received by no later than 11:00 PM on the day of receipt and stored at a temperature of 2-4 °C. Failure to follow these instructions excludes any liability on the part of Tom Tasty.

7. Complaint and Return

7.1 Right of Return

Due to the perishability of the products, returns are excluded.

7.2 Complaints

Complaints must be submitted within 48 hours of receiving the delivery.

8. Purchase by invoice with partial payment option (POWERPAY)

As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview. When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC, POWERPAY’s GTC. (powerpay.ch/en/agb).

9. Limitations of Liability

Tom Tasty declines any liability for damages caused by third parties or unforeseeable circumstances.

10. Data Protection

Data protection is governed by separate privacy policies.

11. Jurisdiction and Dispute Resolution

In the event of disputes, the jurisdiction is Zurich.
